  1. You fall into mortgage arrears
If your mortgage falls into arrears, it is vital that you speak with your lender and try to come to an arrangement as to how you can remedy the problem. You and your mortgage lender will have a variety of remedies that you may be able to employ.
  2. The lender sends letters notifying you of the arrears
If you have not previously discussed the deteriorating position with your lender, the lender will contact you and request that you come to an acceptable arrangement to repay the arrears. It is important that you make every effort to maintain this arrangement and reduce the arrears.
If you fail to do this, and your arrears increase, then the lender's next action will be to instruct legal proceedings.
  3. The lender's solicitor writes to you to request payment
The solicitor will demand that the outstanding arrears are paid within 7 days, or request your proposals as to how the arrears will be repaid. if the solicitor considers your proposals to be unacceptable, they are entitled to commence court proceedings without further notice. Even though this action may be in progress, it remains important that you continue to attempt to come to an arrangement with the solicitor
    to repay the arrears
  4. Court Action
If your arrears situations persists or worsens, then the lender's
solicitor or legal department will now commence action in the court
for repossession of your home, and a warrant for the eviction of all occupants of your home.
